Murder & Manslaughter

Murder requires proof of an intention to kill, or reckless disregard as to whether death is caused, along with knowledge of the risk involved. Manslaughter, by contrast, covers a killing without that level of intent including deaths caused by unlawful acts, criminal negligence, or in some cases, provocation-related circumstances. The distinction between the two carries significant consequences for sentencing.

• Careful management of extensive Crown disclosure, often built up over a lengthy investigation

Homicide cases are almost always resolved by way of trial, given the seriousness of what is alleged. This makes experienced, confident courtroom advocacy essential, from pre-trial disclosure and evidential challenges through to cross-examination and closing submissions before a jury.
